In the course of supporting retail banking operations at many financial institutions of all sizes, we handle litigation involving various payment systems including check and funds transfer disputes arising under UCC Articles 3, 4 and 4A. We also represent the interest of our financial institution clients in a wide variety of litigation arising out of financial fraud schemes targeting our clients and their customers.
Commercial loan workouts and collections
We represent creditors, receivers and other interested parties in connection with a wide variety of troubled credit situations. We have extensive experience in loan restructuring, forbearance negotiations and workouts, collections, asset seizure and liquidation, foreclosures, real estate and title disputes, construction lending matters and administration of participation loan. Where troubled debtors have turned to the bankruptcy process, we have successfully represented lenders in all phases from conversion and trustee appointment issues, litigating fraudulent conveyance and preference claims, equitable subordination and priority disputes, dischargeability litigation, plan confirmation and asset valuation disputes.
